Service of Notice is mandatory

The Customs, Excise & Service Tax Appellate Tribunal (CESTAT) Mumbai held that the Department had failed to prove service of the show cause notice issued under Section 73 of the Finance Act, 1994. 

The Tribunal observed that the statutory requirement is to "serve notice" and not merely "issue notice".
