Executive Summary
The CESTAT held that the classification of imported silver jewellery cannot be prejudged at the stage of provisional release and that Section 110A of the Customs Act permits provisional release even for goods alleged to be restricted or prohibited.
It directed release of the goods solely for re-export, subject to execution of a bond equal to their value.
