Penalty without evidence set aside

The CESTAT, Mumbai, by order dated 31 July 2026, set aside the redemption fine and penalty imposed on an importer of readymade garments, holding that the Department failed to establish misdeclaration or justify confiscation, despite the existence of excess quantity and enhanced valuation.
