NCLT upholds rejection of section 7

The NCLT held that although debt and default ordinarily warrant admission under Section 7, the Adjudicating Authority is not bound to admit an application where the underlying transaction is tainted by credible allegations of fraud, forged corporate approvals, unauthorised bank accounts and ongoing civil and criminal proceedings.
