NCLAT Allows additional Affidavit after remand

The National Company Law Appellate Tribunal (NCLAT), Principal Bench, New Delhi, held that where proceedings are revived and directed to be heard afresh, the matter must be treated as commencing from the inception, thereby permitting parties to supplement their pleadings, subject to the opposite party's right of rebuttal. 

The decision reinforces the primacy of natural justice over procedural technicalities in insolvency proceedings.
