Maintenance of Minimum Average Balance (MAB) Is Not Consideration for Banking Services

The Karnataka High Court quashed service tax show cause notices issued to banks on Minimum Average Balance (MAB) requirements.

The Court held that maintaining a prescribed balance is a contractual condition and not consideration for banking services.

It further ruled that charges for non-maintenance of MAB arise from contractual breach and do not constitute consideration for a taxable service.
