Kerala HC upholds RBIs power to supersede cooperative bank board

The Kerala High Court, held that Section 36AAA of the Banking Regulation Act does not require the RBI to grant a pre-decisional hearing before superseding the Board and affirmed the RBI's authority to replace an elected managing committee where warranted in the interests of depositors and sound banking administration. 

It also clarified that consultation with the State Government is a mandatory statutory requirement.
