ITAT Upholds new tax regime option

The Income Tax Appellate Tribunal, Delhi Bench, by its order dated 5 June 2026 in Sandeep Kumar v. ITO, allowed the assessee's appeal and directed the Assessing Officer to grant the benefit of taxation under the new tax regime prescribed under Section 115BAC of the Income-tax Act.

The Tribunal held that once an assessee exercising business income has opted for the new regime by filing Form 10-IE, the option continues for subsequent assessment years unless it is withdrawn in accordance with law.
