Executive Summary
The proposed India European Union Free Trade Agreement introduces a detailed Rules of Origin framework that will determine whether goods traded between India and the European Union qualify for preferential tariff treatment.
While tariff elimination often receives the most attention in trade negotiations, the true operational gateway to those benefits lies in compliance with origin rules.
The draft agreement establishes clear criteria for determining origin, including the concepts of wholly obtained goods, substantial transformation, and product-specific rules contained in detailed annexes. It also provides defined tolerance thresholds for the use of non-originating materials, particularly for sectors such as textiles where global supply chains are deeply integrated.
The agreement further introduces bilateral cumulation, allowing inputs sourced from the EU to be treated as originating when processed in India. At the same time, it excludes minimal processes such as packaging, labelling, or simple assembly from conferring origin status. Robust documentation and verification procedures have also been incorporated to ensure transparency and prevent misuse of preferential tariffs. Taken together, the Rules of Origin provisions aim to balance supply-chain flexibility with regulatory integrity. For Indian exporters, understanding and structuring operations around these rules will be critical to fully leverage the market access opportunities created by the agreement.
