IBBI order quashed on account of Jurisdictional defect

The Calcutta High Court, by judgment dated 16 July 2026, allowed the writ petition filed by an Insolvency Professional against the IBBI. 

The Court held that the Chairperson lacked jurisdiction to function as the Disciplinary Committee and that the IBBI had failed to undertake the mandatory inspection and investigation contemplated.
