Electricity Consumption alone to indicate clandestine Manufacture

The Karnataka High Court reaffirmed that allegations of clandestine manufacture and removal under the Central Excise Act cannot be sustained merely on the basis of excess electricity consumption. 

In the absence of reliable corroborative evidence establishing unaccounted procurement, manufacture and clearance of goods, the demand and penalties cannot survive.
