EDD refund governed Statutorily

The Madras High Court dismissed the Revenue's appeal concerning refund of Extra Duty Deposit collected from an importer. 

While affirming the importer's entitlement to refund, the Court clarified that such refund is governed by Section 27 of the Customs Act and not by any independent common law remedy.
