Double Duty Barred

The Orissa High Court held that the State cannot recover excise duty twice on the same transaction while implementing an interim judicial order relating to the lifting of Minimum Guaranteed Quantity (MGQ). 

The Court clarified that excise duty already deposited pursuant to an earlier interim order must be adjusted and cannot again be collected through the Odisha State Beverages Corporation (OSBC) wallet mechanism.
